1. Agreement to Terms

By accessing and using AI Written Obituary ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

AI Written Obituary provides:

• Free Obituary Generation: AI-powered obituary writing service at no cost
• Funeral Program Design: Custom funeral program design and printing services for a fee

3. Funeral Program Design Services

3.1 Design Fees

• Bi-fold programs: $25 design fee
• Tri-fold programs: $35 design fee
• Printing costs are separate and based on quantity ordered

3.2 What's Included

• Professional PDF proof delivered within 24 hours of payment
• One (1) round of revisions included
• Custom layout and typography
• High-resolution print-ready files

3.3 Revisions

One round of revisions is included in the design fee. Additional revisions may be subject to additional fees of $10 per revision round. Major redesigns are considered new orders.

4. Refund Policy

Due to the custom nature of funeral program design services:

• Design fees are non-refundable once payment is processed and work has begun
• Printing fees are non-refundable once the order has been sent to production
• We stand behind the quality of our work and will work with you to ensure satisfaction within the scope of included revisions

5. Printing Services

5.1 Timeline

• Design proof: Within 24 hours of payment
• Printing and shipping: 2-3 business days after final approval
• Rush options may be available for an additional fee

5.2 Shipping

Shipping costs are calculated based on quantity and destination. We are not responsible for delays caused by shipping carriers. Please order with adequate time before your service.

5.3 Quality

Programs are printed on premium 100# silk paper at 300 DPI. If you receive damaged or defective programs, please contact us within 48 hours of receipt for a replacement.

6. User Content and Submissions

You retain all rights to content you provide (text, photos, etc.). By submitting content, you grant us a license to use it solely for the purpose of creating your requested designs and fulfilling your order.

7. Prohibited Uses

You may not use our Service to:

• Submit false, misleading, or fraudulent information
• Create content that is defamatory, obscene, or violates third-party rights
• Violate any applicable laws or regulations
• Interfere with or disrupt the Service

8. AI-Generated Content

Our free obituary generator uses artificial intelligence (Claude by Anthropic). While we strive for accuracy and appropriateness, AI-generated content should be reviewed and edited by you before use. We are not responsible for any inaccuracies in AI-generated content.

9. Privacy

We take your privacy seriously. Information you provide is used solely to deliver our services. We do not sell or share your personal information with third parties except as necessary to fulfill your order (e.g., shipping). We use secure payment processing through Stripe.

10. Copyright and Intellectual Property

You may not reproduce, distribute, or create derivative works from our templates, designs, or website content without permission. Designs created for you may be used freely for your intended memorial purposes.

11. Limitation of Liability

To the maximum extent permitted by law, AI Written Obituary shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our Service.

12. Indemnification

You agree to indemnify and hold harmless AI Written Obituary from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
